I agree that a CSI investigation in this type of case is very unrealistic (remember, Germany doesn't have any special punishment for hate crimes [exception: Wiederbetätigung aka Nazi related stuff])).
More realistic would have been to maybe have the police stop by Axel's house and search for the weapon/blood spatter on Axel's clothes. In that case the trial probably would have focused on a he said/he said argument about whether it was more like a bar brawl rather than an attack.
If that didn't happen or Axel was smart enough to hide those things, then there would be the option to interogate him and see if he cracks (and personally, I have a hard time imagining that Axel wouldn't crack or that he would be smart enough to have a good enough lawyer who keeps him from talking).
But yeah, no evidence in Axel's place, no confession, plus potentially an alibi, I can see why that might be seen as a weak case. (which again doesn't mean that a very morally determined judge might not take it)
As for witnesses, again, take he real life case of my friend where they has multiple witnesses who would have testified to that neonazi guy roughing him up and pushing him off the seat he was sitting on the police told them right away that nothing would be done about it/it just wasn't enough. [though I think in their case the police probably thought that he just hadn't been assaulted enough]

On re-watching the video, I noticed something about the scene with Olli and Christian sitting in the bathtub. When Olli takes off his bandage, he looks at it and just kind of hands it to Christian, who then looks at it and gets up to get a new one. The non-verbal exchange and expressions are interesting. The interior monologues I imagine are something like this: Olli removes his bandage, and looks at it as if thinking "Oh, what's this? Ewww. Yuck. Hmm, what do I do with this now? Umm. Oh, I'll give it to this guy. Christian, here, take this. I don't want it." Christian, on being handed the bandages seems to be thinking "Huh? Oh. Why are you giving this to me? I don't want it? *sighs* Oh, all right, I'll get you another one." And he then gets up and replaces Olli's bandage. It's almost as if Olli is discovering his bandage and then passing it off to Christian kind of like a little kid will pass of his empty candy wrapper or used Kleenex to his mother when he could just as easily throw it away himself. And then Christian is seems almost resigned to the bandage change, like they've done this many times before. One could think that maybe they had gone in there to change Olli's bandage, but it seems incidental to the conversation and a bit absent minded. Christian didn't seem to be anticipating the bandage being handed to him. I found it quite funny to watch.

I like it more and more. At the beginning I just thought it was sweet that Christian took it but after watching it like ten times it seems like Olli so has the upper hand. Christian can't say no, so he takes it and gives him a new one. All Olli has to do is look at him and Christian is doing it. It reminds me of the scene when Lydia decided not to leave and Olli gave him a look that said "Help her with her bag".

I don't think Olli is controlling him, rather it's like that since the beginning when Olli could not move without pain, so Christian was changing the band aid for him.
